ADS Property Services have been established since 1968 as an architectural and surveying practice. The practice is based in West Berkshire and has easy access to local motorways and various towns. The proprietor is a Chartered Surveyor with an architectural practice background incorporating structural engineering.

Party Wall

This is one of the primary functions of the practice. The proprietor is an expert in this field, and is on the senior board of management for the Faculty of Party Wall Surveyors

Boundaries

Disputes over boundary matters can often be very expensive, particularly if legal action is taken. ADS Property Services is able to assist in these difficult situations and can usually bring about an acceptable settlement.

Escrow Agency

ADS Property Services are able to hold client’s monies in a special account concerning Security for Expenses as defined under section 12 of the Party Wall etc. Act 1996.

Mediation

ADS Property Services offers the skill of mediation to resolve any building dispute. The costs and success of the mediation process far outweighs taking the legal options.

Expert Witness

Extensive experience generating expert witness reports that are fully CPR compliant and he will appear in court if required. Such reports have been prepared particularly in the case of boundary disputes.

Building Surveys

We undertake building surveys for prospective buyers, particularly for those that may have queries about certain aspects of the property. We will also advise on the potential possibilities for alterations and improvements and what would be required to hopefully obtain approvals under all the various regulations.

We would, of course, advise on any defects found and what remedies there would need to be taken, but we do not undertake valuations as we believe that this should be done at a very local level.

Planning and Design

This is a particular area where we have an abundance of knowledge having prepared plans and designs for thousands of clients over many years.

We are familiar with all Town Planning and Building Regulations of which we can certainly guarantee approval under Building Control for all Local Authorities. In this respect, we are a ONE STOP SHOP, whereby we offer free initial on-site advice, followed by a measured survey.

We prepare the plans for your initial approval, amending as necessary, and of course making a full submission to the Local Authority on your behalf. All structural calculations are prepared in house.

Extensive Party Wall Expertise

Party Wall etc. Act 1996

This is a specialist area for us as we are fully experienced in this field dealing with all aspects from the beginning to the end. Our expertise is second to none.

We will advise on what party wall notices need to be served, what happens either when Consent or Dissent occurs to your proposals. We will deal with the matter very promptly and what is most important is that our costs are extremely competitive.

ADS senior partner Alex Frame is an expert in Party Wall Matters and is president of the Faculty of Party Wall Surveyors. He lectures and has written books and many articles on the subject.

Note! It is very important when undertaking any building works that the Party Wall etc. Act 1996 is considered at an early stage.

Boundary Disputes

This is a specialist subject that we deal with and can be very time-consuming and expensive to deal with especially through the courts. However, our expertise can usually give you the best solution to such boundary problems that arise.

We can prepare new plans for Land Registry, which also includes the necessary plans required for Lease Agreements.

Mediation

We have a highly trained specialist in the team who will be the Mediator in any dispute that you may have. This route is very often used in boundary disputes between neighbours. It naturally avoids any legal recourse to litigation, which can prove to be an extremely costly way to solve the problem. Most disputes using our Mediation method are resolved in a day or more often just half a day. This is all coupled with a legally drafted agreement upon completion.

Benefits of Mediation include:

  • Mediation can be very quick. Sometimes half or day Mediation can bring a matter to a conclusion, which makes it inexpensive. Compared to other forms of dispute resolution, and in particular litigation, it is extremely inexpensive.
  • Mediation is private and confidential so neither party risks any public embarrassment. Parties can often stay on good terms following Mediation.
  • Mediation can be made binding by agreement.
    The parties stay in control of the outcomes without a legal process dictating the matter.
  • Costs are often known and fixed at the outcome.

Escrow Agency

ADS Property Services are able to hold client’s monies in a special account concerning Security for Expenses as defined under section 12 of the Party Wall etc. Act 1996.

The process is quite simple in that we have a prepared Escrow Agreement form that can be used by filing in the blanks of name and address etc and together with certain Identity documents the account can be set up immediately.

This special account is used by many who wish to deposit money to be held as security against works, but have difficulty in finding a solicitor to do so.
